These Terms & Conditions govern the Design Your Own Dildo competition. Read them carefully: by entering the competition, you are agreeing to them.

1. Entrants can enter the competition by submitting an original dildo design in a suitable format (jpeg or PDF) via the competition submission page, along with relevant contact information.
2. Each competition entrant must be at least 18 years of age.
3. Entrants can submit multiple submissions
4. The final deadline for entry to our competition is 09:00am (GMT) on Monday 30th November 2020.
5. There will be three finalists, chosen by UberKinky & Sinnovator employees. These finalists will be put to public vote via UberKinky’s & Sinnovator’s social media channels and one main winner of the Design Your Own Dildo Competition will be selected based on the design which has the highest number of votes. The remaining two designs will be placed as second and third based on the number of votes. The winner will be announced on Monday 7th December 2020.
6. The prizes for the winner of the Design Your Own Dildo Competition are as follows: The main prize is £500 in cash, your winning sex toy design created in a selection of signature colours as chosen by the winner, and the design will be sold on the website. The second prize is an existing Sinnovator toy from UberKinky.co.uk with your own customisation. The third prize is a £75 voucher to spend with UberKinky.
7. The winning design will be featured in a number of campaigns, including social media advertising and website promotion. Their name will be featured on these materials to give added exposure to the creator.
8. NE Services Ltd aka UberKinky will have ownership of the winning design, and will have exclusive rights to sell and distribute the design on www.UberKinky.co.uk, www.Sinnovator.com, and all associated sales channels of NE services.

Once the competition has closed, the creator of the winning design will grant NE Services full license to use, promote, market and otherwise utilise the design in all forms of media, now known or hereafter devised.

1. The ownership of copyright in the work of all submissions will sit with the publishers of the competition, www.UberKinky.co.uk, www.Sinnovator.com, and all associated sales channels of NE services. No entrants or participants shall receive or be entitled to receive any payment in any form for submission or for granting UberKinky any right herein, other than for being selected as one of the winning entries of the competition.
2. If charges of plagiarism are made against an entrant or participant, the charges are to be addressed at the earliest by the accused entrant or participant. UberKinky holds the right to take down the content from all its channels until the matter is resolved.
3. By entering the competition, the entrant acknowledges and accepts that all aspects of any submission narrative, description, details, images, illustration and animation may be used for publicity purposes by UberKinky and Sinnovator.
4. By submitting your entry to the competition, you the “entrant” provide UberKinky with a limited, non-exclusive, sub-licensable, worldwide, royalty-free license (but not the obligation), whose license is effective till perpetuity, to use, copy, modify, translate, and/or adapt, distribute, publicly display by any means and in any media and create derivative works of your entry solely in connection with the inclusion of your entry in activities related to, and the promotion of, the competition and the particular project, without any further notice or remuneration to you. By submitting your entry to the competition you also give UberKinky a non-exclusive, worldwide, royalty-free, irrevocable license in perpetuity, to display and archive your entry on UberKinky and Sinnovator's websites, www.UberKinky.com (“website”) and www.Sinnovator.com, on UberKinky and Sinnovator’s facebook, twitter, instagram or any other social networking / media pages in relation to the competition. Any credits will be with the name you supply for the competition.
5. UberKinky holds the right to publish such material in whole or in part, or use them in any way it sees fit in connection with this website or its competition without permission of the entrant or payment for such use, subject to the provisions of the Data Protection Act 1998.
6. Winners agree to, and shall upon request at a reasonable notice, participate in publicity or promotional activity around the competition, like interviews, personally or otherwise. Each opportunity shall be taken on merit, and each participant or entrant shall have the right to decline any such opportunity.
7. The winner will be notified that they have won (“Prize Notification”) on the date noted in point 6. Prize Notifications will be made through the contact details provided on the entrance page.
8. If the winner does not accept his/her prize by contacting UberKinky by the method specified in his/her Prize Notification (a “Prize Acceptance”), providing such information as UberKinky requests for the purpose of delivering the relevant prize to the winner within 7 days of receipt of the Prize Notification (or any longer period specified in the Prize Notification), he/she will forfeit the prize and another random winner will be selection. We may require the winner to confirm, by way of signature in writing, their agreement to matters referred to in these Terms & Conditions as a condition of Prize Acceptance.
9. There are no cash alternatives to the non-cash prizes.
10. No purchase is necessary to enter the competition.
11. UberKinky may change dates referred to in these Terms & Conditions where, in UberKinky’s discretion, such a change is reasonably necessary.

General

1. Our competitions are not open to employees of UberKinky or its affiliated companies, their families or agents, or to anyone professionally connected with the competition.
2. The promoter of the Design Your Own Dildo Competition is UberKinky.co.uk NE Services Ltd, Savantini House, Foster Street, Hull, HU8 8BT (“UberKinky”, “we” and “us”).
3. UberKinky will hold and use your personal data strictly according to Data Protection Legislation. We will comply with the Data Protection Act 2018. Only your name and affiliation shall be shared for the purpose of publication of submissions on third party platforms.
4. Entry into the Design Your Own Dildo Competition signifies acceptance of these Terms & Conditions.
5. By entering the Design Your Own Dildo Competition, all entrants consent to the use of their personal data by the Promoter for the purposes stated in these Terms & Conditions any other purposes to which the entrant has consented.
6. If any part of these Terms & Conditions is held to be invalid or unenforceable, the remainder shall remain valid and enforceable.
7. Our failure to act with respect to a breach of these Terms & Conditions does not waive our right to act with respect to subsequent or similar breaches.
8. The headings in these Terms & Conditions are for ease of reference only and do not affect the interpretation or construction of these Terms & Conditions.
9. You and we each submit to the non-exclusive jurisdiction of the English courts in relation to disputes arising in connection with these Terms & Conditions.

These Terms & Conditions and the Design Your Own Dildo Competition are governed by the laws of England and Wales
